Avoiding Medicare and Medicaid Fraud and Abuse
The Office of Inspector General (OIG) for the U.S. Department of Health & Human Services has created the educational materials listed below to assist in teaching physicians about the Federal laws designed to protect the Medicare and Medicaid programs and program beneficiaries from fraud, waste, and abuse.
- A Roadmap for New Physicians: Avoiding Medicare and Medicaid Fraud and Abuse (PDF), a booklet for physicians’ self-study.
- A companion PowerPoint presentation (PPT) that we encourage you to use to teach the material contained in the Roadmap.
- The speaker note set (PDF), which will assist you in giving the PowerPoint presentation.
For physicians who may be unable to attend a live, didactic presentation of the material contained in the Roadmap, we also have provided a narration of the speaker notes to accompany the PowerPoint slides.
Resources for the Practice
1. Exposure Control Plan (Bloodborne Pathogens Standard)
There are nine basic requirements of the OSHA Bloodborne Pathogens standard:
- A written plan should be updated annually
- Safety policies should reflect the use of universal precautions
- Always wash hands thoroughly before and after each patient contact. WASH HANDS IMMEDIATELY UPON CONTACT WITH BLOOD OR BODY FLUIDS
- Always wear disposable gloves
- Always properly dispose of contaminated materials in properly labeled red bags
- Never recap used needles.
- Always report exposures or contamination immediately
- Implement the safe use of needles and sharps
- Provide the Hepatitis B vaccine for free to all employees
- Provide medical treatment following exposure
- Use labels or color-coding for used materials
- Provide employee training
- Properly dispose or contain waste

2. Hazard Communication Policy (Hazard Communications Standard)

3. Ionizing Radiation Standards
The ionizing radiation standard applies to facilities that have an x-ray machine and includes four basic requirements:
- A survey of the types of radiation used
- Restrict areas to limit exposure to employees
- Employees working near equipment in restricted areas must wear personal radiation monitors
- Place “Film Badge Required” signs on rooms and equipment
4. Electrical Standards
Many procedures are being performed in the medical office require the use of medical equipment. It is important to perform regular inspections and maintenance of equipment. Failure to develop written policies and procedures for medical office equipment regarding its use and maintenance can lead to equipment failure or malfunction.
Electrical standards address requirements that safeguard employees from injury:
- All staff must be properly trained in the use of all equipment.
- Equipment must only be used by staff for the purpose of performing their job.
- All equipment must be tagged with the inspection date, the due date of the next inspection and the inspector’s initials.
- In the event of failure or malfunction, immediately tag “OUT OF SERVICE”

5. Emergency Exit Routes Standards
The standards for emergency exit routes include two requirements for providing safe and accessible building exits in case of fire or other emergency:
- Provide enough exit routes that sufficiently meet the needs of the number of employees within the medical office
- Diagrams of evacuation routes should be posted in highly visible areas
